Hanes Game in Comfort Contest - Official Rules

1. ELIGIBILITY:

The Hanes Game in Comfort Contest ("Contest") is offered only to individuals who are legal residents of the 48 contiguous United States and the District of Columbia and who are at least 18 years old at the time of entry. Employees, officers and directors of Hanesbrands Inc. ("Hanes" or "Sponsor"), Night Agency LLC ("Administrator"), their respective parent, affiliated and subsidiary companies, advertising and promotional agencies, web masters and web suppliers and persons engaged in the development of Contest and Contest materials, and members of the immediate family (parents, siblings, children and spouse, wherever they reside) or household (whether or not related) of such employees, officers and directors are not eligible. Void where prohibited by law.

2. PROMOTIONAL PERIOD:

Contest begins on November 9, 2009, at 9:00 a.m. Eastern Time (ET) and ends on December 28, 2009, at 11:59:59 p.m. ET (the "Promotional Period"). Administrator's computer is the official clock for the Contest.

3. HOW TO ENTER:

Enter online by visiting the website at www.GameinComfort.com (the "Website") and completing the online entry form with your name, address, e-mail address, telephone number, and age, and a short essay (no more than 1000 characters) explaining how you Game in Comfort. Limit one entry per person per weekly period. Incomplete entries will not be considered.

All entries, including the essays, become the property of the Sponsor. Sponsor may disqualify any essay that it believes, in its sole discretion, is offensive, sexual, violent, or is otherwise inconsistent with the values of the HANES brand. By entering, you acknowledge compliance with these Official Rules, including eligibility requirements, and you agree to all decisions of Sponsor and judges, which are final. By entering, you grant to Sponsor the right to use, post, publish, edit, and/or create derivative works from your essay, and the right to choose not to use, post, publish, edit and/or create derivative works from your essay, in any media and for any purpose without limitation and without compensation or further obligation to you. Sponsor may post essays with the entrant’s first name, last initial and hometown on the Contest Website each week for public viewing. By submitting an entry, you specifically agree to such posting.

4. PRIZE:

Seven (7) Weekly Winners will each receive a Gamer Prize Pack and a Hanes Comfort Fit Prize Pack. Each Gamer Prize Pack includes one Microsoft Xbox 360 Pro console with two controllers and ten games. Each Hanes Comfort Fit Prize Pack consists of the following:

Approximate retail value $200 each

Total approximate retail value of each Weekly Prize is $1,200. Winners are solely responsible for any federal, state and local taxes on the prize. No cash in lieu of prize. No prize transfer or substitution allowed prior to award; however, Sponsor reserves the right in its sole discretion to substitute a prize (or any prize component) with another prize/prize component of equal or greater value if advertised prize/prize component becomes unavailable for any reason. Xbox game titles in each Gamer Prize Pack are subject to Sponsor’s sole discretion. Colors and styles of clothing items are subject to Sponsor’s sole discretion. Sponsor expects to be able to honor size requests, however, Sponsor reserves the right to substitute items, sizes and/or styles in its sole discretion.

5. SELECTION OF WINNERS:

Sponsor or its designee will select one (1) Weekly Winner from among all the eligible entries received for each of the seven weekly periods during the Promotional Period. The weekly periods and the dates on which each Weekly winner will be notified are listed below:

Week 1: Begins at 9:00 a.m. ET on November 9, 2009, and ends at 11:59:59 p.m. ET on November 16, 2009. Winner will be notified via e-mail and/or mail on or about November 19, 2009;

Week 2: Begins at 12:00 a.m. ET on November 17 and ends at 11:59:59 p.m. ET on November 23, 2009. Winner will be notified via e-mail and/or mail on or about November 30, 2009;

Week 3: Begins at 12:00 a.m. ET on November 24 and ends at 11:59:59 p.m. ET on November 30, 2009. Winner will be notified via e-mail and/or mail on or about December 3, 2009;

Week 4: Begins at 12:00 a.m. ET on December 1 and ends at 11:59:59 p.m. ET on December 7, 2009. Winner will be notified via e-mail and/or mail on or about December 10, 2009;

Week 5: Begins at 12:00 a.m. ET on December 8 and ends at 11:59:59 p.m. ET on December 14, 2009. Winner will be notified via e-mail and/or mail on or about January 4, 2010;

Week 6: Begins at 12:00 a.m. ET on December 15 and ends at 11:59:59 p.m. ET on December 21, 2009. Winner will be notified via e-mail and/or mail on or about January 5, 2010;

Week 7: Begins at 12:00 a.m. ET on December 22 and ends at 11:59:59 p.m. ET on December 28, 2009. Winner will be notified via e-mail and/or mail on or about January 6, 2010.

Entries do not carry over from week to week. If you wish to be considered for each weekly prize, you must enter during each weekly period. You may use the same essay, or write a different essay, for subsequent entries. Limit one Weekly Prize per person.

Sponsor or its designee will judge all entries based upon the following criteria: essay best answers the question “Tell us how you Game in Comfort,” essay most demonstrates creativity and originality, and essay best features HANES and gaming.

This is a contest of skill. Your chances of winning depend on how well your entry reflects these judging criteria, as compared to the other entries in the contest during the applicable weekly period.

The entry with the highest total score according to these criteria will be the winner. The potential winner will be notified via e-mail and/or mail on or about the dates listed above. Potential winners must sign and return a Declaration of Eligibility and Liability/Publicity Release (where legal) by 11:59:59 p.m. ET within seven days of notification, in order to claim the prize. If potential winner is a minor in his or her state of residence, then such claim forms must also be signed by a parent or legal guardian. If such documents are not returned on a timely basis, or if notification of prize is returned as non-deliverable, or if a potential winner of the prize is found to be ineligible or not in full compliance with these Official Rules, then the potential winner will be disqualified and the prize will be forfeited. Sponsor will then notify the next highest scoring entry from that weekly period in order to award the prize. Each Weekly prize will be shipped to the winner’s address within 6 to 8 weeks after processing the claim forms.

6. GENERAL CONDITIONS:

All participants (a) agree that Sponsor, Administrator, and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and each of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be indemnified and held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including, without limitation, death, or property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of prize (and/or any prize components), or participation in this Contest or Contest-related activities and (b) acknowledge that said parties have neither made nor are in any manner responsible for any warranty, representation or guarantee, express or implied, in law or in fact, relative to the prize (and/or any prize components), including but not limited to, quality, merchantability or fitness for the intended purpose. Winners grant (and agrees to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsor's authority the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information for advertising, trade, publicity and promotional purposes without limitation in any media worldwide, including the Internet, without review, notification or approval, or further compensation to the winner, unless prohibited by law.

Sponsor is not responsible for lost, late, incomplete, stolen, misdirected or illegible entries, mail or e-mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/website/use net accessibility, availability, or traffic congestion, or any technical error, or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture, or loss of, any such information. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Website. The right is reserved by Sponsor at its sole discretion, to disqualify any individual found to be tampering with the entry process, the operation of the Contest or the Website, or to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods is strictly prohibited and will result in the disqualification of any entrant using such methods, in Sponsor's sole discretion. The use of alternate names, addresses, e-mail address, handles, or other personal information to submit additional entries by a single individual will result in disqualification of all entries by that individual, in Sponsor’s sole discretion. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from the Website or use of the Website. If the Contest is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and to judge the entries received prior to and/or after (as appropriate) the action taken by Sponsor or to otherwise make prizes available to be won in a manner deemed by Sponsor in its sole discretion, to be fair, appropriate and consistent with the spirit of these Official Rules. In case of dispute, entries will be declared made by the authorized account holder of the email address provided in the entry form. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet Access Provider, Online Service Provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize winner. These Official Rules are intended solely for the personal use by an individual participant and may be reproduced only once for his/her personal use; any further reproduction of these official rules is prohibited.

IN NO EVENT WILL SPONSOR, ADMINISTRATOR, THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE WEBSITE. 7. WINNERS LIST:

For the names of the Weekly Winners, mail a self-addressed stamped envelope to: Night Agency LLC, Hanes Game in Comfort Contest Winners, 307 Canal Street, 2nd Floor, New York, NY 10013. Vermont residents may omit return postage. Winners list requests received after December 31, 2009, will not be fulfilled. Allow 6-8 weeks for processing request.
